Prison expected for New Madison man for child sex offense

GREENVILLE – A New Madison man pleaded guilty to one charge in one of the cases pending against him Wednesday afternoon and is expected to face prison time for at least that offense.

David Michael Tinkham, 56, of New Madison, entered a plea of guilty in Darke County Common Pleas Court to one count of gross sexual imposition, a third-degree felony, involving a child younger than 10 years old. Two additional GSI counts were dismissed as part of the plea agreement.

Tinkham’s attorney, Randall Breaden, and Darke County Assistant Prosecuting Attorney Deborah Quigley jointly recommended a three-year prison term for Tinkham. The conviction also would include mandatory registration as a Tier II sex offender.

The maximum penalty for a third-degree felony gross sexual imposition charge is five years in prison and a $10,000 fine.

The crime reportedly occurred July 31, 2015, and his subsequent indictment led to the reopening of a case involving similar accusations against Tinkham from the mid-1990s.

Tinkham has been charged with three counts of first-degree rape and four counts of sexual battery, third-degree, felonies in that case, which also involved a female younger than 10.

He could face up to life in prison on his remaining charges.

Also in court Wednesday, Robert S. Rismiller, 37, of Greenville, entered a guilty plea to a charge of assault, a first-degree misdemeanor, amended from his original indictment for domestic violence.

He faces a maximum penalty of six months in jail and $1,000 in fines.
