Child porn, assault and domestic violence top Darke County court arraignments

GREENVILLE – A Greenville man was arraigned via video link Friday in Darke County Common Pleas Court on a charge of pandering obscenity involving a minor for allegedly taking several inappropriate photos of a young family member.

Denville T. Boseke, 32, of Greenville, was assigned Randall Breaden as his public defender and had a plea of not guilty entered by the court on his behalf for the felony charge.

Representing the state, Assistant County Prosecutor Deborah Quigley requested that bond be set at $50,000 with a no-contact order, noting “the state views this as a very serious offense.” She said that Boseke had taken several photos of the girl and had severely violated his “position of trust” as an adult family member.

Boseke requested release on his own recognizance, as he has no criminal record and said he is not a flight risk.

Judge Jonathan P. Hein, while noting that the charge represented “very serious conduct,” reminded those in the courtroom that defendants are innocent until proven guilty under the law and that the process of setting bond was not meant to be a punishment for an alleged crime but rather was about the accused reliably appearing as ordered by the court to face those charges.

Boseke was then ordered released on his own recognizance under terms of supervision and was ordered to have no contact of any kind with the alleged victim.

In other court activity Friday, Earl Marion Sloan Jr., 58, of Arcanum, was sentenced to up to five years of community control sanctions after pleading guilty in December to a reduced charge of aggravated assault, a fourth-degree felony, for a BB gun attack last summer. Sloan was arrested in July after reportedly assaulting someone with a BB gun before making threats with a machete.

Hein told Sloan that he is used to “often tell(ing) young kids who sit in (the defendant’s) chair to grow up” but that he should not have to do the same for a man of Sloan’s supposed maturity. Hein further advised Sloan that, in the future, if has problems with his neighbors he should call law enforcement and “let the people in the stars and bars handle it” rather than engaging in vigilante justice himself.

“Fighting a young punk is going to get you hurt anyway,” Hein added.

Also arraigned Friday was Lindsey Foster, on a fourth-degree felony complaint of domestic violence. She was released on her own recognizance and ordered not to live with the alleged victim in the case, although a no-contact order was not issued.

Hein noted that the alleged victim had called the court and asked that the case not be prosecuted, so Hein declined to order no contact, but he noted that the victim’s wishes do not decide if a case is prosecuted, as charges on criminal activity are brought by the state rather than the victim.

Quigley had recommended a bond of $5,000 with a no-contact order, citing the accused has a previous criminal record for domestic violence.
