Darke County Common Pleas Court hears burglary, drug cases

GREENVILLE — Darke County Common Pleas Court heard cases involving drugs, burglary and domestic violence on Monday. Judge Jonathan P. Hein presided.

Wayne Richardson, age 29, of Greenville, was sentenced on charges of burglary, a third-degree felony. The charge stems from an incident in which Richardson allegedly stole jewelry from a family member of his wife, which he then pawned. Richardson’s previous record includes theft and drug-related charges in Fayette County, Indiana, for which he is still on probation.

Defense attorney Randall Braeden said his client was a good candidate for community control and asked the court to put off any jail time until after the defendant had had a chance to pursue surgery for back and hip problems, which had previously prevented him from working. Richardson said he had left Indiana to escape family issues that had led to his previous offenses.

“Everybody makes mistakes,” Richardson said.

“That’s what they call a silly statement,” Judge Hein responded. “What’s the common denominator in all the situations where you’re in trouble? You’re not reading very well on paper, so if you’ve got something else to offer, you need to prove it.”

Hein sentenced Richardson to 36 days in jail, with 11 days credit for time already served, as well as post-release supervision. He also must pay restitution, seek and maintain employment, abstain from alcohol and illegal drugs and perform 40 hours of community service.

“Prove me wrong,” Judge Hein said after sentence was handed down. “Show me you’re not a thief and show me you can take care of your kids.”

Timothy Shellenbarger was arraigned on charges of domestic violence, a fourth-degree felony carrying penalties of up to 18 months in prison and a potential $5,000 fine, as well as charges of disorderly conduct and underage consumption. Shellenbarger’s attorney, David Rohrer, entered a not guilty plea on his client’s behalf and asked that Shellenbarger be released on his own recognizance. His next court appearance is a status conference to be held Dec. 10.

Larry McGuire, age 68, of New Paris, was arraigned on multiple counts of aggravated possession of drugs and possession of drugs, all fifth-degree felonies, and one count of operating a motor vehicle while under the influence, which carries a mandatory driver’s license suspension if convicted. Defense attorney Rohrer entered a not guilty plea on McGuire’s behalf and did not object to Darke County Assistant Prosecutor James Bennett’s request to continue the defendant’s $25,000 bond. McGuire’s next court appearance is a pre-trial conference to be held Dec. 10.

Joseph Braun, age 48, of Greenville, was arraigned on charges of possession of fentanyl, a fifth-degree felony carrying up to 12 months in prison and a possible $2,500 fine. Braun entered a not guilty plea and asked that an attorney be appointed to represent him; Judge Hein appointed attorney Randall Braeden. Braun was released on his own recognizance; his next court appearance is a status conference to be held Dec. 10.

Larry McGuire, age 68, of New Paris, was arraigned on multiple counts of aggravated possession of drugs and possession of drugs and one count of operating a motor vehicle while under the influence.
