Boseke pleads guilty

GREENVILLE — A Greenville man charged for taking cell phone pictures of a young girl pleaded guilty to an amended charge in Darke County Common Pleas Court Friday.

Denville T. Boseke, 32, of Greenville, appeared in court Friday with his attorney, Christopher Bucio, to plead guilty to a charge of illegal use of a minor in nudity oriented material, a second-degree felony and Tier II sex offense. He was originally indicted on a charge of pandering obscenity involving a minor, which also is a Tier II sex offense and second-degree felony. The charges stemmed from conduct of Jan. 27 of this year.

Deborah Quigley of the Darke County Prosecutor’s Office represented the state.

Speaking on the plea arrangement, Quigley said of the amended charge, “This is an allied offense of similar import.” She said while the state will “stand silent” at sentencing, the victim or a representative of the victim is expected to make a victim impact statement to the court at the time of sentencing.

Judge Jonathan P. Hein explained to Boseke the maximum penalty for the charge would be eight years in prison and a $15,000 fine, none of which is mandatory. If a prison term is ordered, Boseke also is subject to five years of post-release control by the state probation department.

According to the plea negotiation entry, prison is not mandatory but it is presumed necessary in this case.

As a Tier II sex offender, Boseke also will be required to register as a sex offender every six months for 25 years.

A presentence investigation was ordered, and sentencing was set for Aug. 15 at 11 a.m
