Bradford man gets prison time for sex crimes against daughter

GREENVILLE — Two men, registered sex offenders, were sentenced to a total of 17 years in prison between them after pleading to charges of sex crimes in Darke County Common Pleas Court Monday.

Laverne W. Frame, 45, formerly of Bradford, was indicted in October on two counts of rape and three counts of sexual battery based upon an investigation by the Darke County Sheriff’s Office (DCSO). Frame allegedly was having a forcible sexual relationship with a close relative and had fathered as many as three children with her. The rape charges date from incidents in 2007, and the sexual battery charges are dated August 2008, October 2012 and December 2014.

Darke County Prosecuting Attorney said the dates on the charges were based on nine months prior to the birth dates of the children.

Frame entered guilty pleas to the three sexual battery charges, in addition to another sexual battery charge which was amended from a rape charge, all third-degree felonies. One count of rape was dismissed.

In court Monday, Frame and his defense attorney, Randall Breaden, claimed the relationship was consensual but did not deny that it was still in violation of the law. Frame said he knew he was “guilty under the law” but that he “can’t be sorry for loving someone.”

The state recommended a combined prison term of 15 years, and defense requested a six-year prison term to run consecutively with the four-year prison sentence Frame recently received in Mercer County for a total of 10 years.

Frame asked for no additional time beyond the four years from Mercer County, arguing that not being able to see his children was punishment enough. He suggested the judge bar him from contact and then add more prison time if he violates that no-contact order. He showed little to no remorse for the crime, and held his victim largely as responsible as he was for the inappropriate sexual relationship.

“We didn’t plan this,” Frame told the court. “If they want to call them victims, yeah, maybe so … I knew it was wrong. She knew it was wrong.”

Judge Jonathan Hein told Frame that predatory sexual action toward a relative has always been aberrant behavior in any society. In his sentencing, he split the difference between the two recommendations, giving Frame three years on each of the four charges to run consecutively, with the Darke County sentence to be served concurrently with the Mercer County one. He was given 101 days credit for time served. Frame also will be required to register for life as a Tier III sex offender.

Also in court Monday, Edward Evilsizor, 43, was sentenced to the mutually agreed upon five years in prison on a charge of pandering obscenity involving a minor, a second-degree felony. He was given credit for 103 days time served.

According to Assistant County Prosecutor Deborah Quigley, Evilsizor downloaded then copied a pornographic video involving a child believed to be younger than 5 years old. Evilsizor has previously served 18 months in prison on burglary and theft charges, and he also was previously sentenced to five years in prison for a similar pandering charge in Shelby County. He was on parole at the time of the current offense, which was in February 2015.

In addition to his prison term, Evilsizor will be required to register as a Tier II sex offender for 25 years and be under post-release control for five years.

Teddy Hunt was sentenced to 71 days in jail with 41 days credit for a fifth-degree felony trafficking in heroin charge. he also was ordered to pay restitution of $125 for lab fees and perform 75 hours of community service. He will be under five years of community control. If he fails to comply with the terms of his community control, he will be sent to prison for 11 months, Hein said.
