Penny makes an appearance for alleged felonious assault

GREENVILLE — A woman arrested for an alleged felonious assault outside Spirit Medical Transport, LLC, on Sweitzer earlier this week made an initial appearance in Darke County Common Pleas Court on Wednesday.

Tori L. Penny, 26, of Ansonia, currently in the Darke County Jail, went before Judge Jonathan P. Hein via video conference for the second-degree felony that carries up to 8 to 12 years in prison and a maximum $15,000 fine.

Prosecuting attorney Kelly Ormsby noted that while the court should consider prison time for the offense, he understood from authorities Penny had no prior record and would accept either a low bond or an own recognizance bond.

“As long as she understands the importance of appearing in court,” continued Ormsby. He further noted the alleged male victim had a parole violation and was sent back to the Ohio Department of Rehabilitation and Corrections, so there was “not much danger in contact between her and him unless she goes out of her way to find it.”

Penny was released on an OR bond, no contact with the victim, and a preliminary hearing in municipal court slated for May 7.

Also appearing in Darke County Common Pleas Court via video from the county jail were the following:

*Bryan S. Adkins, 41, of Hollansburg, arraigned for trafficking in drugs (methamphetamine) a third-degree felony. He faces nine months to three years in prison and a $5000 to $10,000 fine. He was released on an OR bond with a pre-trial conference slated for June 15.

*Ricky J. Martin, 32, of Greenville, for an initial appearance, assault on a peace officer, a fourth-degree felony with up to 18 months incarceration and a $5,000 fine. Bond was set at $10,000 with a preliminary hearing slated for May 7.
